1. The Promotion
These terms an conditions refer to any competition run by Stonesoup Words & Pictures PO Box 140
Bungendore, NSW, 2620 AUSTRALIA “ABN” 37297475143 (the “Promoter”, “we”, “us”). By entering, each entrant agrees to be bound by these Terms and Conditions.
2. Entry Period
Entries open as oer the dates on the competition entry page (the “Entry Period”). Entries received outside the Entry Period, or that are incomplete, illegible, or submitted through unauthorised means, will not be considered.
3. Eligibility
The Competition is open to individuals worldwide, subject to the exclusions in this clause and in Section 12 (Sanctions and local law).
Entrants must be 18 years of age or older, or the age of majority in their place of residence if higher, and must have the legal capacity to accept these Terms.
Directors, officers, employees, and contractors of Stonesoup Words & Pictures, and their immediate family members (spouse, parent, child, sibling) or household members, are not eligible to enter.
Each person may submit one entry only. Multiple, duplicate, or automated entries (including multiple accounts or email addresses used by the same individual) may be disqualified at the Promoter’s discretion.
The Promoter may verify an entrant’s eligibility at any time and may disqualify any entry it reasonably believes to be fraudulent, ineligible, or in breach of these Terms.
4. Cost to Enter
Entry is free. No purchase of any product or service is necessary to enter or to win.
5. How to Enter
During the Entry Period, eligible individuals may enter by completing the entry form. Each entrant may optionally state, on their own entry, the name and/or email address of the friend who referred them to the Competition, for the purposes of the Referral Bonus described in Section 7.
6. Judging and Selection of Winners
Two winners will be selected based on originality, insight, and alignment with the theme of the entry question, assessed by Jules Clancy (the “Judge”).
Judging will take place within [2 business days] of the Entry Period closing. The Judge’s decision is final and binding, and no correspondence will be entered into regarding the outcome of judging.
If, for any reason, an insufficient number of entries of adequate merit are received, the Promoter reserves the right not to award a prize for that position.
7. The Referral Bonus — “When You Win, They Win”
An entrant may state, on their own entry, the full name and/or email address of the friend who referred them to the Competition (the “Referring Entrant”); the entrant making that statement is the “Referred Entrant”.
If a Referring Entrant is selected as one of the two winners under Section 6, the Referred Entrant who correctly identified them will also receive the Prize described in Section 8, provided the Referred Entrant independently meets the eligibility criteria in Section 3 and the Promoter is reasonably satisfied that the referral is genuine.
A referral is “correctly identified” where the name and/or email provided by the Referred Entrant reasonably matches the details the Referring Entrant used on their own entry, as determined by the Promoter acting reasonably (minor typos or formatting differences will not disqualify a genuine match).
Only one Referral Bonus will be awarded per winning Referring Entrant. If more than one entrant names the same Referring Entrant, the Promoter will treat the entry received earliest during the Entry Period as the Referred Entrant, unless the Promoter reasonably determines another outcome is more appropriate (for example, where the earliest entry appears fraudulent).
If a winning entrant was not named as a referrer by any other entrant, or the Referred Entrant who named them is later found ineligible or the referral cannot be verified, no substitute Referral Bonus will be awarded in their place.
Self-referral, and any referral the Promoter reasonably believes to be fictitious, coordinated, or otherwise made to game this clause, will not be honoured and may result in disqualification of the entries involved.
The maximum number of Prizes awarded under this Competition, across both winners and their Referred Entrants, is stated on the entry page.
8. The Prize
Each Prize consists of one (1) twelve-month membership to the Naturally Healthy Club group coaching program, with an approximate retail value of [$2388] per Prize (total prize pool [AUD $4776] if both Prizes are awarded).
The Prize is not transferable or exchangeable, and cannot be redeemed for cash, in whole or in part, except at the Promoter’s sole discretion.
If a Prize (or any element of it) becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute it with a prize of equal or greater value.
The Prize is delivered as access to an online program and requires the winner to have their own internet access and device; the Promoter is not responsible for providing this.
9. Notification of Winners
Winners (and, where applicable, their verified Referred Entrant) will be notified by email and text message to the address and phone number provided at entry within [2 business days] of judging. A winner who does not respond to claim their Prize within [5 days] of first being contacted may forfeit the Prize, and the Promoter may, at its discretion, select an alternative winner or not award that Prize.
10. Taxes and Other Costs
Winners are solely responsible for any income tax, duty, customs charge, or other levy arising from their receipt or use of the Prize under the laws of their country or state of residence. The Promoter makes no representation as to the tax treatment of the Prize in any jurisdiction.
11. Use of Personal Information and Privacy
Personal information collected through this Competition (including a referrer’s name/email and phone number provided by another entrant) is collected and used by the Promoter to administer the Competition, notify and fulfil Prizes, and, where separately consented to, to send marketing communications, in accordance with the Promoter’s Privacy Policy..
Entrants located in the European Economic Area or United Kingdom have rights under the GDPR/UK GDPR, including rights to access, correct, and request deletion of their personal information; entrants located in California have equivalent rights under applicable state privacy law. Entry information will not be sold to third parties. It may be shared with service providers who help operate the Competition (e.g. form or email platforms) solely for that purpose.
12. Sanctions and Local Law
This Competition is void where prohibited or restricted by law. It is not open to residents of any country or region subject to comprehensive trade sanctions administered by Australia, the United States, the United Nations, or the European Union (as at the time of writing, illustratively including Cuba, Iran, North Korea, Syria, and the Russian-occupied regions of Ukraine — the Promoter will confirm the current list before each Entry Period).
It is the entrant’s responsibility to determine whether their entry into, and receipt of a Prize from, this Competition is lawful in their country of residence. The Promoter may require an entrant to confirm this before awarding a Prize.
13. Health Disclaimer
The Naturally Healthy Club program provides general food, lifestyle, and wellbeing coaching in a group setting. It is not medical, dietetic, or psychological advice, diagnosis, or treatment, and is not a substitute for consulting a qualified health professional. Entrants and winners should speak with an appropriate health professional before starting the program or making significant changes to diet, eating patterns, or exercise, particularly if they have an existing health condition. The Promoter does not guarantee any particular health, weight, or wellbeing outcome from participation in the program.
14. Publicity
By accepting a Prize, each winner consents to the Promoter using their first name and any testimonial they provide about their experience, in the Promoter’s marketing (including website, email, and social media), without further compensation, unless prohibited by law. Winners may decline to provide a testimonial or photo without affecting their entitlement to the Prize.
15. Liability
To the maximum extent permitted by law, the Promoter (including its officers, employees, and agents) excludes all liability for any loss, damage, cost, or personal injury (whether direct, indirect, or consequential) arising out of or in connection with this Competition or a Prize, except for any liability that cannot be excluded by law, including consumer guarantees under the Australian Consumer Law or equivalent mandatory consumer protections that apply in an entrant’s country of residence.
16. Amendment, Suspension, and Cancellation
The Promoter reserves the right, at any time, to amend these Terms, or to suspend or cancel the Competition, if fraud, technical failure, or any other factor beyond its reasonable control impairs the fair or proper administration of the Competition, subject to any written directions of a relevant regulator. The Promoter is not responsible for entries lost, delayed, or misdirected due to technical or network issues outside its reasonable control.
17. Platform Disclaimer
If this Competition is promoted on a third-party platform (e.g. Instagram or Facebook), it is in no way sponsored, endorsed, administered by, or associated with that platform. Any questions must be directed to the Promoter, not the platform.
18. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and the Promoter and each entrant submit to the non-exclusive jurisdiction of the courts of that place. This does not remove any mandatory consumer protections an entrant is entitled to under the law of their own country of residence.
